Escrow impound account cushion in San Diego
Quick answer: Federal RESPA rules (12 CFR 1024.17) cap the escrow cushion at one-sixth of your estimated yearly tax and insurance bills, which is about two months of escrow payments. If your property tax is $9,000 a year and homeowners insurance is $2,400, the monthly escrow piece is $950 and the cushion can be no more than $1,900. That is my arithmetic on example numbers, not your quote.
I get this question on almost every San Diego purchase: why is there a big "initial escrow deposit" on my Closing Disclosure? It is not a fee. It is your own money parked in the impound account so the servicer can pay your property tax and insurance on time.
The rule in plain terms
The servicer can collect two things at closing. First, enough to cover taxes and insurance from the last time they were paid up to your first payment date, sized so the account never projects below zero. Second, a cushion. The federal rule says that cushion can be no greater than one-sixth of the estimated total annual payments from the account. The servicer can use a smaller cushion or none. After closing, the monthly escrow piece is one-twelfth of the yearly bills, plus whatever keeps the cushion in place.
- Yearly tax plus insurance: $11,400 in the example above.
- Monthly escrow: $11,400 divided by 12 is $950.
- Maximum cushion: $11,400 divided by 6 is $1,900.
Why San Diego tax dates move the number
San Diego County secured property tax is paid in two installments. The first is due November 1 and goes delinquent after December 10. The second is due February 1 and goes delinquent after April 10. The servicer has to plan disbursements on or before those penalty dates, so the month you close changes how much it needs up front. A fall closing right before the first installment can look heavier than a summer closing. See property tax installments at closing for the date side.
What happens after year one
The servicer runs an escrow analysis every year. If it finds a surplus of $50 or more and you are current, it has to refund it within 30 days. If there is a shortage, it can spread repayment over at least 12 months. Your first year in a new home often triggers a supplemental bill, which can create a shortage. See the supplemental property tax bill guide.
I build the impound deposit into your cash to close before you write an offer, so it is not a surprise. Start at get pre-approved San Diego.
None of this changes loan size. The 2026 San Diego County 1-unit conforming limit is $1,104,000 per FHFA. Jumbo generally starts above that. VA full entitlement is not capped the same way. See loan limits. Company NMLS 2394495. Amir Nurani NMLS 197458. Call (619) 366-9494.
Frequently asked questions
It is extra money held in your impound account to cover bills that come before your monthly payments build up. Federal rules cap it at one-sixth of the estimated yearly tax and insurance payments from the account.
No. It is your money held to pay your own property tax and insurance. It shows up in cash to close, but it is not a lender fee.
Not under the RESPA limit. The cushion can be no greater than one-sixth of the estimated total annual disbursements, which works out to about two months of escrow payments. A servicer can collect less or none.
If the annual analysis shows a surplus of $50 or more and you are current on payments, the servicer must refund it within 30 days.
Often a supplemental tax bill or a higher insurance premium. The annual analysis catches it, and a shortage can be spread over at least 12 months.
